使用山顶Tutor应用程序（以下简称"本应用"）即表示您同意本用户协议（以下简称"本协议"）。如果您不同意，请停止使用本应用。 By using the 山顶Tutor application ("the App"), you agree to these Terms of Service ("Terms"). If you do not agree, please stop using the App.

本协议是您与山顶学具教育咨询（文山市）有限公司（以下简称"我们"）之间的法律协议。 These Terms are a legal agreement between you and Shanding Xueju Education Consulting (Wenshan) Co., Ltd. ("we", "us", or "our").

1. 服务描述 · Service Description

本应用是一款语言学习工具，主要提供以下功能： The App is a language learning tool that primarily provides:

  • AI对话：通过文字或语音与AI助教对话，进行语言练习与提问 · AI conversation: chat with an AI tutor by text or voice for language practice and questions
  • 词汇追踪：自动记录您查阅或学习过的生词及相关信息 · Vocabulary tracking: automatic tracking of words you have looked up or learned
  • 双语阅读辅助：对您导入或粘贴的语言学习内容提供双语对照、词汇释义等辅助 · Bilingual reading assistance: bilingual side-by-side display, vocabulary lookups, and other assistance on language-learning content you import or paste
  • 跨设备同步：在不同设备之间同步您的学习数据 · Cross-device sync: sync your learning data across devices

我们可能会随着应用的迭代更新增加、调整或下线相关功能。 We may add, adjust, or discontinue features as the App is updated over time.

2. 账户注册与安全 · Account Registration & Security

  • 您必须提供有效的电子邮件地址以创建账户 · You must provide a valid email address to create an account
  • 您有责任维护账户的安全 · You are responsible for maintaining the security of your account
  • 每人限一个账户 · One account per person
  • 您必须年满 18 周岁方可创建账户。本应用不面向未满 18 周岁的未成年人。 · You must be at least 18 years old to create an account. The App is not directed at minors under 18.
  • 我们可能会暂停或终止违反本协议的账户 · We may suspend or terminate accounts that violate these Terms

3. 合理使用 · Acceptable Use

您同意不会： You agree not to:

  • 将本应用用于任何违反中华人民共和国法律法规的目的 · Use the App for any purpose that violates the laws and regulations of the People's Republic of China
  • 使用AI聊天生成、传播违法违规信息，包括但不限于危害国家安全、扰乱社会秩序、侵犯他人合法权益的内容 · Use AI chat to generate or distribute illegal content, including but not limited to content that endangers national security, disrupts social order, or infringes on the lawful rights of others
  • 试图绕过AI安全措施 · Attempt to circumvent AI safety measures
  • 使用自动化工具、机器人或脚本访问本应用 · Use automated tools, bots, or scripts to access the App
  • 反向工程、反编译或反汇编本应用的任何部分 · Reverse engineer, decompile, or disassemble any part of the App
  • 与他人共享账户登录信息 · Share your account credentials with others
  • 从本应用大量抓取或提取数据 · Scrape or extract data in bulk from the App

4. AI生成的内容 · AI-Generated Content

本应用使用人工智能提供语言学习辅助。您理解并同意： The App uses artificial intelligence to provide language learning assistance. You understand and agree that:

  • AI回复仅供语言学习之用，不构成专业、医疗、法律或财务建议 · AI responses are for language learning purposes only and do not constitute professional, medical, legal, or financial advice
  • AI生成的内容可能包含错误，包括不正确的翻译、语法解释或事实信息 · AI-generated content may contain errors, including incorrect translations, grammar explanations, or factual information
  • 我们不保证任何AI生成内容的准确性 · We do not guarantee the accuracy of any AI-generated content
  • 您应该独立验证重要信息 · You should verify important information independently

5. 用户内容 · User Content

您保留在本应用中创建的内容（文本、笔记、词汇数据等）的所有权。使用本应用即表示您授予我们有限的许可，以存储、同步和处理您的内容，以提供服务所必需。 You retain ownership of content you create in the App (texts, notes, vocabulary data, etc.). By using the App, you grant us a limited license to store, sync, and process your content as necessary to provide the service.

您有责任确保您的内容不违反中华人民共和国法律法规或第三方权利。 You are responsible for ensuring that your content does not violate the laws and regulations of the People's Republic of China or third-party rights.

6. 知识产权 · Intellectual Property

本应用（包括其设计、代码、功能和品牌）是山顶学具教育咨询（文山市）有限公司的财产。您被授予有限的、非排他性的、不可转让的许可，以将本应用用于个人语言学习目的。 The App, including its design, code, features, and branding, is the property of Shanding Xueju Education Consulting (Wenshan) Co., Ltd. You are granted a limited, non-exclusive, non-transferable license to use the App for personal language learning purposes.

7. 第三方服务 · Third-Party Services

本应用的服务端整合了阿里云提供的第三方服务，包括 DashScope 语音识别、通义千问大模型（对应算法"达摩院交互式多能型合成算法"已通过国家网信办备案，备案号 网信算备330110507206401230035号）、阿里云 OSS/CDN 等。本应用作为接入方调用这些已备案的服务，相关服务有各自的服务条款，我们不对其可用性、内容或政策负责。 The App's backend integrates third-party services provided by Aliyun, including DashScope speech recognition, the Tongyi Qianwen LLM (its corresponding algorithm "DAMO Academy Interactive Multimodal Synthesis Algorithm" is filed with the national CAC under filing number 网信算备330110507206401230035号), and Aliyun OSS/CDN. The App acts as a downstream integrator of these already-filed services; each has its own terms of service and we are not responsible for their availability, content, or policies.

8. 本地优先数据 · Local-First Data

本应用采用本地优先架构，您的数据主要存储在您的设备上。您理解： The App uses a local-first architecture where your data is stored primarily on your device. You understand that:

  • 您对本地数据负责：如果您卸载本应用或清除应用数据，未同步到云端的本地数据将会丢失 · You are responsible for your local data: if you uninstall the App or clear app data, local data that has not been synced to the cloud will be lost
  • 云端同步用于备份和同步您的数据，但不保证始终可用 · Cloud sync is provided to back up and sync your data but is not guaranteed to be always available
  • 我们不对因设备故障、应用卸载或数据清除导致的本地数据丢失承担责任 · We are not liable for loss of local data due to device failure, app uninstallation, or data clearing

9. 服务可用性 · Service Availability

本应用按**"现状"**提供，不附带任何形式的保证。 The App is provided "as is" without warranties of any kind.

  • 我们不保证服务不间断或正常运行时间 · We do not guarantee uninterrupted service or uptime
  • 我们可能随时修改、更新或停止某些功能 · We may modify, update, or discontinue features at any time
  • OTA更新可能会改变应用功能 · Over-the-air updates may change app functionality

10. 未来的付费功能 · Future Paid Features

我们未来可能推出付费功能或订阅服务。届时，我们将在任何购买之前提供单独的付款条款、价格和退款政策，并严格遵守中华人民共和国消费者权益保护相关法律法规。 We may introduce paid features or subscriptions in the future. If so, separate payment terms, pricing, and refund policies will be provided before any purchase, in full compliance with the consumer protection laws and regulations of the People's Republic of China.

11. 责任限制 · Limitation of Liability

在法律允许的范围内： To the extent permitted by law:

  • 我们不对任何间接的、附带的、特殊的或后果性的损害承担责任 · We are not liable for any indirect, incidental, special, or consequential damages
  • 我们不对AI生成内容的准确性负责 · We are not liable for the accuracy of AI-generated content
  • 我们的总责任限于您在索赔前12个月内向我们支付的金额（如有） · Our total liability is limited to the amount you have paid us in the 12 months preceding the claim, if any
  • 本条款不排除或限制因我们故意或重大过失导致损害的赔偿责任 · These Terms do not exclude or limit liability for damages caused by our intentional misconduct or gross negligence

12. 终止 · Termination

  • 您可以随时通过本应用删除账户 · You may delete your account at any time through the App
  • 如果您违反本协议，我们可能会暂停或终止您的访问权限 · We may suspend or terminate your access if you violate these Terms
  • 终止后，您的云端数据将被删除。您设备上的本地数据将保留，直到您自行移除 · Upon termination, your cloud data will be deleted. Local data on your device remains until you remove it

13. 协议变更 · Changes to Terms

我们可能会不时更新本协议。更新后的协议将在本页面发布，并注明最后更新日期。重大变更时，我们将通过应用内通知或邮件方式告知您。在协议变更后继续使用本应用即表示接受更新后的协议。 We may update these Terms from time to time. Updated terms will be posted on this page with the last updated date. For significant changes, we will notify you through in-app notifications or email. Continued use of the App after changes constitutes acceptance of the updated Terms.

14. 争议解决 · Dispute Resolution

本协议受中华人民共和国法律管辖。因本协议或您使用本应用而产生的任何争议，双方应首先通过友好协商解决；协商不成的，应提交至山顶学具教育咨询（文山市）有限公司所在地有管辖权的人民法院解决。 These Terms are governed by the laws of the People's Republic of China. Any disputes arising from these Terms or your use of the App shall first be resolved through friendly negotiation; if negotiation fails, the dispute shall be submitted to the competent People's Court in the jurisdiction of Shanding Xueju Education Consulting (Wenshan) Co., Ltd.

15. 可分割性 · Severability

如果本协议的任何条款被认定为无效或不可执行，其余条款将继续完全有效。 If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
